Riverland Internet

Hosting terms and conditions

Website Content
Riverland Internet does not allow adult oriented sites including pornography, sex-related merchandising, and hate sites. This includes sites that may infer sexual content, or links to adult content elsewhere. This is also true for sites that promote any illegal activity or content that may be damaging to our servers or any other server on the Internet. Links to such materials are also prohibited.

Riverland Internet reserves the right to remove web content without prior notification upon receiving a Takedown Notice from the Australian Broadcasting Authority. Riverland Internet will attempt to notify the contact listed on record after this occurred.

Server Resources
Any website that uses a high amount of server resources (such as, but not limited to, CPU time, memory usage, disk space and network bandwidth) will be given an option of either paying extra (which depends on the resource needed) or reducing the resource used to an acceptable level. Riverland Internet shall be the sole arbiter of what is considered to be a high server usage level.

UCE (Unsolicited Commerce Email) - SPAM
Spamming, or the sending of mass unsolicited email, from or through a Riverland Internet server or using an email address that is maintained on a Riverland Internet machine is STRICTLY prohibited. Riverland Internet will be the sole arbiter as to what constitutes a violation of this provision. If you engage in any of the foregoing activities using the service of another ISP or IPP, but channelling activities through a Riverland Internet server as a maildrop for responses, you are still in violation. Violators will face an immediate suspension of their account, with no eligibility for refund of any fees paid.

System Security
Customers may not use the Riverland Internet network to attempt in any way to circumvent user authentication or security of any host, network, or account. This includes, but is not limited to, accessing any data not intended for the customer, logging into any server or account the customer is not expressly authorized to access, password cracking, probing of other networks, or violation of any other organization's security policy. Customers may not attempt to interfere or deny service to any user, host, or network. This includes, but is not limited to, flooding, mail bombing, or other deliberate attempts to overload or crash a host or network. Riverland Internet will cooperate fully with investigations of violations of systems or network security at other sites, including cooperating with law enforcement authorities in the investigation of suspected criminal violations. Users who violate system or network security may incur criminal or civil liability.

Maintenance
Riverland Internet will perform scheduled maintenance to servers from time to time. Wherever possible we will attempt to perform all scheduled maintenance at times which will minimise disruption to customers, and notify customers in advance through our "Riverland Internet News" page.

Unscheduled maintenance may need to be performed. If unscheduled maintenance requires the Hosting Service to be off-line for more than 2 hours, we will post details of the outage/event to our "Riv Net News" page after the maintenance has been completed.

Archiving of Data
We will attempt to archive your data onto backup mechanisms on a regular basis for the purposes of disaster recovery. In the event of equipment failure or data corruption, we will restore from the last known good archive. If our archives are corrupted or unusable you should be prepared to upload your website and data if required.

Accounts
Accounts will be issued via email when the hosting has been set up, tested and working. Hosting charges are payable for one year in advance, and are not refundable.

Default Accounts unpaid thirty (30) days after the date of invoice will be considered in default. If the Customer in default maintains any information or files on its web space, Riverland Internet may, at its discretion, remove all such material from its Web space. Removal of such material does not relieve the Customer of its obligation to pay any outstanding charges owing by the Customer. Customers with accounts in default agree to pay Riverland Internet's reasonable expenses, including solicitor fees and costs for collection by third-party agencies, incurred in enforcing these Terms and Conditions.

The customer is required to inform Riverland Internet in writing giving signed 30 days notice, by way of fax or normal postal mail or by hand delivery, to terminate a service. Email or verbal notice is not acceptable as we require a real signature. Until this is done, the customer understands they are still incurring monthly or any other contractual charges and fees even if a service is suspended.

Contacts
The customer is required to provide Riverland Internet with correct and up to date contact details for billing and technical notification purposes. It is the customer's responsibility to ensure these details are kept up to date. Riverland Internet takes no responsibility for any disruption to services due to inability to contact the customer.

Defects and Faults
Riverland Internet will do its best to provide highly reliable services. However it does not guarantee they will be continuous or fault free. Riverland Internet and its employees, servants, contractors or agents are not responsible for any losses or costs, liabilities, claims or proceedings whatsoever (including loss of profits or business loss and whether as a result of negligence or otherwise) which you or any other person may suffer as a result of a defect, fault or temporary failure to provide any server or service.
